Acto seguido se hará comparecer al reo, a quien se notificará la resolución de convocatoria, y se le advertirá que debe nombrar un defensor militar, oficial en servicio activo o en uso de buen retiro. Si no hace el nombramiento, el Presidente le nombrará un defensor de oficio. Posesionado el defensor, y sin la presencia del reo, se oirán en sesión secreta los informes del funcionario de instrucción.
