El auto en que se niegue o se decrete una separación de Juez o Magistrado, es apelable en el efecto suspensivo; y en el que se niegue o se decrete una separación o recusación, en el devolutivo, pero no se proferirá sentencia definitiva mientras el incidente no se haya fenecido.
