En ningún caso la existencia de un pacto colectivo en una empresa impedirá al sindicato de sus trabajadores presentar pliego de peticiones y suscribir convención colectiva de trabajo. Tampoco la existencia del pacto colectivo podrá alterar la aplicación del principio según el cual a trabajo igual desempeñado en puesto, jornada y condiciones de eficiencia también iguales, debe corresponder salario igual.
