Valor del plan de premios. El valor total del plan de premios deberá estimarse por su valor comercial, incluido el IVA. Así mismo, cuando se ofrezcan premios en los cuales la persona natural o jurídica que realiza el sorteo promocional asume el pago de los impuestos correspondientes, el valor de dicho impuesto o impuestos deberá adicionarse al valor comercial del plan de premios, para efecto de cálculo de los derechos de explotación.
