Art 112. Las fianzas de costas se constituyen por diligencia que se extiende en el mismo expediente, en el cual se expresara la cantidad fijada por el juez para la responsabilidad del fijador, diligencia que firmaran el Juez, el Fijador y el Secretario. Copia de la diligencia de la fianza, de la tasación de costas y del auto aprobatorio de estas, la cual subscribirán los mismos funcionarios, puede procederse ejecutivamente contra el fijador hasta por la cantidad por la cual se atribuyó responsable, si la tasación de las costas ascendiere a ellas.
