º. La determinación de los predios aptos para la parcelación, corresponde al Gobierno, pero en igualdad de condiciones se preferirían los que han de ser beneficiados por el Fondo Rotatorio de Irrigación y Desecación. El Gobierno reservará, por medio de resoluciones ejecutivas, los terrenos baldíos que destine a la parcelación. Declárese la utilidad pública e interés social la adquisición por el Estado de tierras pertenecientes a particulares para ser parceladas en los términos y con las finalidades económicas y sociales del presente Decreto.
