Las partes pueden separada o conjuntamente desistir del pleito, reconvención, incidente, o recurso que hayan propuesto en él; y, para ello, deben presentar personalmente ante el Secretario un escrito en que así lo manifiesten.

El desistimiento se hace ante el Juez o Tribunal que esté conociendo del juicio, incidente o recurso de que se trate, en cualquier estado del negocio.
