Decreto 4635 de 2011 · por el cual se dictan medidas de asistencia, atención, reparación integral y de restitución de tierras a las víctimas pertenecientes acomunidades negras, afrocolombianas, raizales y palenqueras.

Oportunidad procesal. Para llevar a cabo estos mecanismos de resolución de conflictos, se tendrán en cuenta las siguientes reglas

Si estos conflictos son identificados en el trámite de caracterización territorial, la Unidad Administrativa Especial de Gestión de Restitución de Tierras Despojadas propiciará de oficio la resolución de los conflictos identificados en los artículos precedentes;

Una vez el Consejo Interétnico de Conciliación y Justicia ad hoc resuelva dicho conflicto y levante el acta respectiva, esta se remitirá inmediatamente a la Unidad Administrativa Especial de Gestión de Restitución de Tierras Despojadas que a su vez la incorporará al expediente que se presentará ante el Juez junto con la solicitud de restitución.
