Si el Juez encuentra probada una excepción perentoria, no tiene obligación de estudiar las demás propuestas o alegadas. El silencio del Juez no impide que el superior estudie y falle las otras, si encuentra infundada la que el Juez consideró probada, aunque el excepcionante no haya apelado de la sentencia.
