Articulo 40. De la utilización de las listas de elegibles. Durante la vigencia de las listas de elegibles, las vacantes definitivas deberán proveerse con las personas que figuren en ellas, siempre que se trate de cargos para los cuales se concursó. En todo caso se seguirán estrictamente las normas que consagran derechos preferencia les para efectos de promociones o respecto de funcionarios escalafonados cuyos empleos se hubieran suprimido.
