Art. 2° La presunción legal establecida en el artículo anterior, de que hay graves motivos de utilidad pública en la construcción de ciertas obras o adquisición de ciertos objetos, admite prueba en contrario en cada caso particular; y si ella fuere plenamente satisfactoria á juicio del Juez o Tribunal respectivo, no se decretará la expropiación.

Se exceptúa el caso en que una ley haya declarado de pública utilidad la obra especial de que se trata.
