Derechos del capturado. A toda persona capturada se le hará saber en forma inmediata:

1. Los motivos de su aprehensión.

2. Que tiene derecho a nombrar defensor y a conferenciar con él y que si no lo hace se le designará de oficio.

3. Que tiene derecho a señalar la persona a quien se debe comunicar su aprehensión, lo que se hará de inmediato a una de ellas.

4. Que tiene derecho a guardar silencio y a saber que todo lo que diga podrá ser utilizado en su contra.
