Los destinos públicos se proveen por la autoridad que en cada caso, designen las leyes, ordenanzas, acuerdos o reglamentos. En caso de silencio o duda, regirán las reglas siguientes: si el destino fuere del orden nacional, lo proveerá el Presidente de la República; si del orden departamental, el Gobernador del Departamento, y si del orden municipal, el Alcalde del Municipio.
