Si el procesado rehusare contestar, o se fingiere loco, sordo o mudo, y esta simulación pudiere comprobarse en cualquier forma, el funcionario se limitará a poner de presente al procesado que su actitud en vez de impedir la prosecución del proceso, lo podrá privar de algunos medios de defensa.
