No pueden desistir:

Los incapaces por sí o por sus representantes legales, salvo que el Juez les autorice con conocimiento de causa.

Los curadores ad litem, con la misma salvedad.

Los apoderados que no tengan facultad expresa para ello; y

Los Agentes del Ministerio Público, sino en los casos en que se les autorice en forma legal por las entidades que representan.
