El Jefe del Resguardo es funcionario de instrucción en el puerto de su destino, en la bahía y en las costas respectivas, para averiguar las faltas de la misma naturaleza de las expresadas en los artículos anteriores que tengan mayor pena señalada en el Código Penal o en la presente Ley y como tal levantará a prevención la sumaria del caso y la pasará al Juez competente.
