El Fondo Rotatorio, adscrito al Departamento Administrativo de Seguridad (DAS), es un establecimiento público del orden nacional, esto es, un organismo dotado de personería jurídica, autonomía administrativa y patrimonio independiente, que se organiza conforme a las disposiciones de los Decretos 1050 y 3130 de 1968, a la Ley 4ªde 1981 y a las contenidas en los presentes estatutos.
