Toda persona está en la obligación de rendir bajo juramento, el testimonio que se le solicita en la actuación procesal, salvo las excepciones constitucionales y legales. Al testigo menor de doce (12) años no se le recibirá juramento y en la diligencia deberá estar asistido, por su representante legal o por un pariente mayor de edad a quien se le tomará juramento acerca de la reserva de la diligencia.
