Si el heredero o legatario cuyos derechos a la sucesion no han prescrito, fallece ántes de haber aceptado o repudíado la herencia o legado que se le ha deferido, trasmite a sus herederos el derecho de aceptar dicha herencia o legado o repudiarlos, aun cuando fallezca sin saber que se le ha deferido.

No se puede ejercer este derecho sin aceptar la herencia de la persona que lo trasmite.
