El que estando en capacidad de trabajar mendigue públicamente, será castigado con arresto por uno a cinco días, en caso de reincidencia, el arresto puede elevarse a un mes.

Esta pena puede aplicarse haciendo trabajar al penado en obras de utilidad pública.
