La persona a quien se designe para Delegado Departamental del Estado Civil deberá reunir las siguientes condiciones: ser colombiano de nacimiento, mayor de 25 años y gozar de una alta reputación de probidad y rectitud.

El nombramiento de Delegado Departamental del Estado Civil no podrá recaer en quien haya sido elegido para un cargo de elección popular en los dos años anteriores a su designación, o haya pertenecido a un directorio político en el mismo período.
