Los miembros de la Fuerza Pública en servicio activo, cuando cometan delitos de competencia de la justicia Penal Militar, sólo podrán ser juzgados por los jueces y tribunales establecidos en este Código e instituidos con anterioridad a la comisión de la conducta punible.
