A ningún funcionario del orden judicial o del Ministerio Público puede prorrogársele por causa de enfermedad la licencia concedida, sino cuando aquélla le impidiere realmente el ejercicio de las funciones del empleo. Cuando la licencia se concede por esta causa, el empleado tiene derecho, durante ella, a la mitad sueldo.
