Art. 49. Surtida la diligencia de que trata el artículo anterior, se dará traslado el artículo anterior, se dará traslado del expediente por cuarenta y ocho horas al Fiscal, para que emita precisamente concepto en el fondo, solicitando sobreseimiento o auto de proceder, con cita de la parte del escrito que juzgue culpable, si es el caso, y de las disposiciones legales que repute infringidas.
