Se considera justificada la abstención electoral en una determinada votación cuando dentro de los quince (15) días siguientes a los escrutinios municipales el interesado demuestra, de manera fehaciente ante el Registrador Municipal o Distrital del Estado Civil o Cónsul del lugar donde está inscrita su cédula, que no sufragó por fuerza mayor o caso fortuito.

Si el Registrador Municipal o Distrital del Estado Civil o el Cónsul aceptare la excusa, expedirá el certificado electoral de que trata el artículo siguiente.

Si la excusa no fuere aceptada, el interesado podrá apelar la decisión ante el superior inmediato.
