El funcionario de instrucción que, aun por negligencia, omitiere la práctica de las diligencias que sean necesarias para comprobar el cuerpo del delito y el descubrimiento de los autores o participes, incurrirá en multa de veinticinco a cien pesos, que impondrá disciplinaria y sumariamente el juez a quien corresponda calificar el mérito del sumario.
