Los Jueces de Tierras fallarán sobre lo que resulte de la inspección ocular y demás elementos de convicción producidos por las partes o allegados de oficio al informativo, y según la persuasión racional. Aplicarán el derecho teniendo en cuenta que el objeto de esta jurisdicción especial es que la ley sustantiva se interprete con el criterio de que no deben protegerse el enriquecimiento sin causa, el abuso del derecho y el fraude a la ley.
