Cuando el funcionario competente recibiere el expediente sin formulación de cargos y estimare que es procedente formularlos, procederá en la forma indicada en el artículo 18 de la presente Ley. En caso contrario, ordenará que se archive el expediente y se dé cuenta de ello al Jefe del organismo correspondiente.
