El Gobierno puede nombrar un mismo funcionario de instrucción y un mismo fiscal, para varias Brigadas o unidades operativas, Fuerzas Aéreas y Armada Nacional, así como también designar una misma persona que tenga el doble carácter de juez y de funcionario de instrucción en cada Brigada o unidad operativa. Puede también elegir del personal permanente de funcionarios de instrucción de las Fuerzas Militares, uno que actué en determinada investigación.
