Transcurrido un (1) año sin que la ocupación haya terminado, procede la restitución de oficio del inmueble. La demora en cumplir este mandato será causal de mala conducta para el funcionario o funcionarios que dilaten la entrega. Los propietarios, poseedores o tenedores podrán iniciar inmediatamente las acciones judiciales encaminadas a la restitución del bien y la reparación del daño inferido.
