Agotamiento Del Foes

°. Agotamiento del FOES . Conforme con lo previsto en el artículo 118 de la Ley 812 de 2003, el FOES expirará cuando ocurra el primero de los siguientes eventos

El agotamiento de las Rentas de Congestión, o

El cumplimiento del término de ocho (8) años, contados a partir de la vigencia de la Ley 812 de 2003. Para los efectos del presente artículo las Rentas de Congestión se entenderán agotadas cuando se verifique cualquiera de los siguientes hechos: (i) cuando el Ministro de Minas y Energía con fundamento en la información suministrada por el ASIC certifique que no se producirán más Rentas de Congestión, o (ii) cuando transcurran más de tres (3) años continuos en que no se generen Rentas de Congestión.
