°. Las pensiones especiales de que trata el artículo 28 del Decreto 104 de 1994, deberán ser reconocidas por la administradora de pensiones a la cual se encuentre afiliado el Magistrado. Para tal efecto, la administradora de pensiones reconocerá y pagará la pensión especial, procediendo a exigir a la Nación el pago de la cuota parte correspondiente.
