Ley Aplicable En Caso De Conflicto De Leyes

Ley 1676 de 2013 · por la cual se promueve el acceso al crédito y se dictan normas sobre garantías mobiliarias.

La ley aplicable a la constitución, oponibilidad, registro, prelación y ejecución será la del Estado en el que se encuentre el bien objeto de la garantía mobiliaria.

Si el bien garantizado suele utilizarse en más de un Estado, la ley aplicable será la del Estado en el que se encuentre el garante.

Si el bien garantizado es objeto de inscripción en un registro especial, la ley aplicable será la ley del Estado bajo cuya jurisdicción esté el registro.
