Si no hubiere proceso, la solicitud de amnistía será resuelta por el Tribunal Superior del Distrito Judicial correspondiente. Recibida la documentación el Tribunal Superior por conducto de la Sala Penal de Decisión concederá de plano la amnistía. El Magistrado Sustanciador tendrá tres (3) días para presentar proyecto y solo dos (2) días para decidir. La Providencia quedará ejecutoriada con su pronunciamiento.
