La limitación de responsabilidad consagrada en el artículo anterior no se aplicará a las obligaciones derivadas de acto o culpa personal del armador, ni a las obligaciones contraídas en nombre o por cuenta de éste, por la agencia marítima o el capitán, cuando aquellas haya utilizado o ratificado especialmente, ni a las relativas a los contratos de trabajo con el capitán, con la tripulación o con las demás personas al servicio de la nave.
