ARTICULO 5o. Potestad sancionatoria. La facultad que tiene la Superintendencia Bancaria para imponer sanciones por las infracciones en que incurran las entidades sometidas a su control y vigilancia se ejercerá exclusivamente estableciendo la conformidad de los hechos o actos con las normas legales vigentes al momento en que aquéllos hayan ocurrido. En consecuencia, la modificación ulterior de las normas infringidas no eximirá de la aplicación de la sanción establecida al momento de la infracción, a menos que expresamente se prevea una disposición en tal sentido.
