ARTICULO 328 . Revocación de la resolución inhibitoria . La resolución inhibitoria podrá ser revocada de oficio o a petición del denunciante o querellante, aunque se encuentre ejecutoriada. El denunciante o querellante podrá insistir en la apertura de la instrucción, sólamente ante el funcionario que profirió la resolución inhibitoria, siempre que aparezcan nuevas pruebas que desvirtúen los fundamentos que sirvieron de base para proferirla.
