La investigación formal o etapa instructiva, que será adelantada por un Magistrado Instructor, comienza con la resolución de apertura de la investigación en la que además de ordenar la iniciación del proceso, se dispondrá a comprobar sus credenciales como gerontólogo recibir declaración libre y espontánea, practicar todas las diligencias necesarias para el esclarecimiento de los hechos y la demostración de la responsabilidad o la inocencia del o de los gerontólogos.
