Cuando la sentencia que se dicte en los juicios de oposición fuere favorable a la parte que se opone a la expedición de la patente, no se dará curso a la solicitud respectiva, o se cancelara la patente, si se trata de una ya concedida. En estas sentencias se condenara a la parte desfavorecida al pago de las costas judiciales.
