No hay lugar a procedimiento en los casos de que tratan losArtículos que preceden, sino mediante acusación del cónyuge ofendido, quien debe incluir en su acusación al cómplice del adulterio o a la concubina.

La acusación no se admitirá sino en un plazo de noventa días, a partir de la fecha en que el cónyuge ofendido tuvo noticia del hecho.

Tampoco se admitirá la acusación del cónyuge por culpa del cual se dictó la sentencia de separación.
