Los contratos que celebre la Empresa para el desarrollo de sus actividades no están sujetos, salvo disposición en contrario, a las formalidades que la ley exige para los del Gobierno. Las cláusulas que en ellos se incluyan serán las usuales para los contratos entre particulares, pero en los términos del artículo 254 del Código Contencioso Administrativo se podrá pactar el derecho a declarar la caducidad, incluyendo como fuere el caso, las prescripciones pertinentes sobre reclamaciones diplomáticas.
