ART 197. El castigo señalado á la injuria por el Código Penal, supone la publicidad y mayor gravedad del delito.

Faltando la publicidad ó la mayor gravedad, ó ambas circunstancias, se aplicará la mitad de la pena que hubiera de corresponder al delito íntegro; ó bien, la multa únicamente, con arreglo al grado de menor publicidad ó á la menor gravedad del hecho ó á ambas circunstancias, según el prudente arbitrio del juzgador.
