La Fiscalía General Penal Militar estará integrada para el ejercicio de la acción penal por el Fiscal General Penal Militar, los fiscales penales militares delegados ante el Tribunal Superior Militar, los fiscales delegados y los funcionarios que él designe y estén previstos en el estatuto orgánico de la institución para esos efectos de acuerdo a la ley que expida el Congreso de la República.
