º Los Personeros Municipales de cabecera de Circuito actuarán bajo la dirección de los correspondientes Fiscales de Circuito y como delegados de éstos en las funciones del Ministerio Público ante los Juzgados de Circuito de su respectiva sede. Los Fiscales de Circuito podrán asumir directamente, en j todo momento, las funciones de Ministerio Público, desplazando al Personero Municipal que se encuentre actuando. Queda así derogado el artículo 164 de la Ley 105 de 1931 y adicionado el artículo 94 de la Ley 94 de 1938.
