Corresponderá al capitán o al agente marítimo la custodia de las cosas descargadas, hasta cuando se entreguen, reembarquen, depositen o vendan.

Sin perjuicio de la responsabilidad del transportador, la violación de esta obligación hará responsable al capitán o al agente marítimo de los daños que se causen, salvo que acredite que se debieron a fuerza mayor.
