Cuando se trate de hijos extramatrimoniales será suficiente la autorización de la madre, a menos que hubieren sido reconocidos, en cuyo caso la autorización será otorgada por ambos padres. No se requerirá autorización del padre que haya sido declarado tal en proceso contradictorio.
