Son funcionarios de instrucción:

Los encargados del detall.

Los Ayudantes.

Los Oficiales Adjuntos o de Estado Mayor de las Unidades superiores.

Parágrafo

Para la averiguación de los delitos cometidos por individuos que deban ser juzgados por los Consejos de Guerra Superiores serán funcionarios de instrucción los Oficiales Superiores designados , anticipadamente por el Comandante de la Unidad superior (División o Brigada), o cualesquier Oficiales idóneos que elija el Poder Ejecutivo.
