°. Vigilancia y control . Para efectos de la vigilancia y control que deben ejercer las direcciones departamentales y distritales de salud sobre las donaciones, el Invima deberá reportar periódicamente, las autorizaciones que hayan sido otorgadas para ser utilizadas en el respectivo territorio.

Parágrafo

Cuando el receptor desvíe, se apropie, o haga mal uso de una donación, el producto se considerará fraudulento y en consecuencia será sujeto de las sanciones previstas en las normas sanitarias vigentes, en especial el Decreto 677 de 1995 y demás normas que lo modifiquen, adicionen o sustituyan.
