º La garantía que de conformidad con el artículo 23 de la Ley 36 de 1918 debe exígirse por anticipaciones de sueldos o por cuenta de viáticos, consistirá en cauciones reales, prendarias o hipotecarias, sin perjuicio de que acepten simples fianzas en casos especiales, a juicio del Ministerio del Tesoro o de la Tesorería General de la República.
