°. Determinación de los dividendos y participaciones no gravados. Para efectos de determinar la utilidad máxima susceptible de ser distribuida como ingreso no constitutivo de renta ni ganancia ocasional, de conformidad con lo previsto en el numeral 1 del artículo 49 del Estatuto Tributario en concordancia con el artículo 5° lb., al resultado de la sumatoria de la renta líquida y la ganancia ocasional gravables, se resta el resultado que se obtenga de sumar el impuesto básico de renta y el impuesto de ganancias ocasionales liquidados por el mismo año gravable.
